« Division of competences between the Administrative Tribunal and the judicial tribunals, principles established in the case law of the Council of Competence Conflicts », is a practical guide that analyzes the major jurisprudential principles and orientations established by the Council within the framework of its role in resolving disputes related to jurisdiction that may arise between the judicial courts and the Administrative Court, and consequently in determining the competent court.
This guide covers approximately 500 decisions rendered by the Council of Competence Conflicts since May 6, 1999, the date of its first decision. This guide is part of the valorization of the work accomplished by the Council and its role in promoting the constitutional right of access to justice.
The guide is intended for the main actors and stakeholders in the field of jurisdictional litigation, namely the litigants, lawyers, judges, researchers, and all specialists in this field.
