Tunisia: Guide on judicial review for local authorities

The Tunisian Constitution of 2014 introduced an important principle, namely the ex-post judicial review of acts of local authorities, for which the Administrative Court and the Court of Audit are competent, as well as the abolition of any kind of ex-ante administrative review. This principle has been anchored in the Local Government Code.

Given the lack of information in the codes of procedures, which ensure the proper implementation of constitutional provisions, in the Local Government Code and various other texts in force, as well as the complexity of the legal texts, we decided to produce a manual to clarify the principle of ex-post judicial review of acts of local authorities, the application of this review on the work of local groups, as well as the relevant procedures for its exercise.
